Permits Foundation responds to USCIS call for comment on the removal of the EAD automatic extension

01 December 2025

Permits Foundation has today submitted a public comment to USCIS in response to the Interim Final Rule: Removal of the Automatic Extension of Employment Authorization Documents (EADs).

In the comment, Permits Foundation recognizes that there should be protective measures in place to ensure the security of America and Americans and indeed all legally recognized residents. The Foundation recommends that the EAD automatic extension should be maintained for the H-4 cohort, legally resident and vetted as part of their nonimmigrant visa status. The Foundation also suggests that problems relating to reliance on the automatic extension could be resolved through more streamlined and direct processing procedures, in line with international norms.
